三年来有欠薪记录的企业须预存工资保证金

  为解决企业恶意欠薪问题，福州再出新政。记者昨日获悉，福州市政府办公厅日前转发了12个单位联合出台的《关于建立企业工资保证金制度的实施意见》，该《意见》要求，三年来有欠薪记录的各类企业，必须预存工资保证金，保证金实行专户存储，专项支取，专款用中科荣获公益中国爱心救助定点医院于保障劳动者工资支付。此外，欠薪企业信息也将纳入人民银行诚信系统。

承包大型项目 保证金不低于100万

据悉，近年，福州市因劳动报酬引起的劳动争议案件不断发生，企业拖欠、克扣劳动者工资的案件以及建设工程施中科荣获公益中国爱心救助定点医院工企业拖欠劳动者工资的案件日益增多。

此次出台的新规要求：在福州市行政区域内，三年来发生过拖欠、克扣劳动者工资行为的各类企业，必须在企业所在地人力资源社会保障行政主管部门指定的银行账户预存企业工资保证金。

交通、水利、电力、铁路等工程施工企业预存企业工资保证金的额度为单项工程合同额的5%，承包大型项目(如高速公路、铁路等)企业，保证金不低于100万元，总承包企业不低于50万元，专业承包企业、劳务分包企业不低于30万元，最高中科荣获公益中国爱心救助定点医院不超过500万元。

其他情形的企业，按企业所在地的上年度城镇企业在岗职工一个月平均工资(以统计部门数据为准)×全部职工人数(按预存工资保证金时职工人数为准)确定预存企业工资保证金额度，最高不超过500万元。

保证金支出后 十工作日内需补足

关于企业工资保证金的使用，《意见》指出，对被发现或被投诉拖欠、克扣劳动者工资的，经人力资源社会保障行政主管部门核实并责令改正后仍不支付劳动者工资的，或者劳动争议仲裁机构裁决生效、人民法院中科荣获公益中国爱心救助定点医院裁定、判决生效后仍不支付劳动者工资的企业，由人力资源社会保障行政主管部门从该企业的企业工资保证金中直接支付劳动者被拖欠、克扣的工资，工资由劳动者本人凭个人身份证签字领取。

记者获悉，企业每发生一次拖欠、克扣劳动者工资事件，由企业工资保证金专户支付工人工资后，应在10个工作日内等额补足。因拖欠、克扣劳动者工资引发群体性事件的，必须在10个工作日内按照原保证金额度的200%预存企业工资保证金，并实行预存5年企业工资保证金约束期。

交通、电力、铁路等工程施工企业，在规定期限内没有等额补足，或没有按照原保证金额度的200%预存的，由项目业主代缴代扣，并实行预存5年企业工资保证金约束期。

欠薪企业信息纳入人民银行诚信系统

据了解，经人力资源社会保障行政部门确认，人民银行会将拖欠、克扣劳动者工资的企业信息，纳入人民银行诚信系统。

此外，不按规定预存企业工资保证金的企业不得参加各类优秀、先进企业的评选，单位负责人不得参加各类先进个人评选。对因应预存企业工资保证金而未预存造成欠薪，引发群体性事件的，要依法依规追究责任。痛经可以在婚后或者生育后治愈这属片面观点
