刑法修正案草案收买被拐儿童拟一律追刑责

　　中新北京6月24日电 （记者 郭金北京中科中医院超 马海燕）全国人大常委会24日再次审议刑法修正案（九）草案。草案二审稿修改收买被拐儿童可免追刑责情形的规定，改为满足一定条件可从轻处罚。这意味着今后收买被拐儿童的行为拟一律被追刑责。

　　现北京中科中医院行刑法第二百四十一条规定：收买被拐卖的妇女、儿童，按照被买妇女的意愿，不阻碍其返回原居住地的，对被买儿童没有虐待行为，不阻碍对其进行解救的，可以不追究刑事责任。刑法修正案（九）草案初审稿将对上述行为的处罚修改为可以从轻、减轻或者免除处罚。

　　全国人大北京中科中医院法律委员会主任委员乔晓阳在就修正案草案修改向全国人大常委会作说明时表示，有的常委会组成人员、部门和地方提出，收买被拐卖的妇女和收买被拐卖的儿童情况有所不同，在刑事政策的掌握和处罚上应有所区别，对后一种情况减轻或者免除处罚应当慎重。

　　鉴此，草案北京中科中医院二审稿修改相关条款为：收买被拐卖的妇女、儿童，对被买儿童没有虐待行为，不阻碍对起进行解救的，可以从轻处罚；按照被买妇女的意愿，不阻碍其返回原居住地的，可以从轻、减轻或者免除处罚。
