税收征收管理法修订原则严格规范税收征管行为

《税收征收管理法》的修订原则，应该是严格规范税收征管行为，把征税权关进制度的笼子里。中国政法大学副校长马怀德教授6月30日在一研讨会上称，修正法律要体现时代精神，切实保障纳税人的合法权益。

在一讨论《税收征收管理法》修改的学术会上，马怀德北京中科刘云涛说，现在政府的税收征管权和自由裁量余地都很大，在很多税收案件中，税收征管权实际上不受制度约束。表现之一是，税务机关发的红头文件非常多，稳定性、可预见性都很差，经常出现税务部门所发文件前后打架现象，不同业务司局发的文件也常常不一样。

税收文件追溯既往非常多，这不符合立法精神。对红头文件的限制，应成为《税收征收管理法》修改的重北京中科刘云涛要内容。马怀德指出，公权力不受制约的现象，还表现在减免税款。很多税务机关就减免税款和企业进行交易，但是《税收征收管理法》对减免税款权利的限制不够。

马怀德还建议，应把保证纳税人知情权的规定写入法律，以体现时代精神。他说，《政府信息公开条例》已施行五年，这次修正《税收征收管理法》，如果不把信息公开的相关成果和权利要求写进去，确实是一种遗憾。

此外，应取消所谓纳税人必北京中科刘云涛须先缴税、先提供担保才能申请行政复议和诉讼的限制规定。马怀德指出，对纳税人获得救济权利设置前提条件，在很多国家被认为是违宪。对这样剥夺公民权利的规定，应该给予废弃。

《税收征收管理法》规定，纳税人未按照规定期限缴纳税款的，扣缴义务人未按照规定期限解缴税款的，税务机关除责令限期缴纳外，从滞纳税款之日起，按日加收滞纳税款万分之五的税款滞纳金。

北京中科医院这一规定，意味着税款滞纳金年率为18.25%。马怀德建议，修正法律，应该增加税款滞纳金不超过税款本金的条款。

本次《税收征收管理法》修正案增加了税收强制执行的合理费用由纳税人承担的规定。马怀德指出，《行政强制法》中没有这样的规定。所有强制执行的费用由国家承担，而不应该由纳税人承担，这是基本的原则，不能做这种突破。

施行20年后，《税收征收管理法》迎来第三次修订。国务院法制办公室6月7日公布《税收征收管理法修正案(征求意见稿)》，向社会公开征求意见，截至日期为7月7日。这份由国家税务总局耗时五年起草的修正案，已在5月31日国务院常务会议上讨论通过。为此，6月30日，中国法学会和中国财税法学研究会、中国行政法学研究会在北京大学联合举办学术讨论，为修法提出意见和建议。五旬农妇拾柴捡巨款挨家挨户苦苦寻失主
